This Policy explains how cancellations, refunds and project changes are handled by Ivan Moshe Studio, operated by Ivan Moshe.

It should be read together with our Terms and Conditions.

Nothing in this Policy limits cancellation, refund or consumer rights that cannot lawfully be waived or restricted.

1. Nature of Our Services

Ivan Moshe Studio provides professional creative services, many of which are:

  • commissioned for a specific client;
  • produced to an individual brief;
  • customized using client-supplied products, photographs or brand materials;
  • scheduled according to client requirements;
  • created through professional labor that begins before final delivery.

Because of this, cancellation and refund treatment may depend on how far the project has progressed when cancellation is requested.

2. Before Production Begins

If you request cancellation before production has begun, contact us as soon as possible.

Where permitted by applicable law and subject to the specific order terms, amounts paid may be refundable except for:

  • non-refundable third-party expenses already incurred with your approval;
  • costs that cannot reasonably be recovered;
  • work already expressly authorized and performed.

Any mandatory statutory cancellation rights continue to apply.

3. After Production Has Begun

Once substantive work has begun, a full refund may not be available to the extent permitted by applicable law.

Depending on the circumstances, we may calculate an appropriate amount based on:

  • work already completed;
  • production time reserved or used;
  • approved external costs;
  • completed deliverables;
  • irreversible commitments made specifically for the project.

For bespoke or customized creative services, the client’s statutory cancellation rights may differ from those applicable to ordinary standardized goods or services. Any mandatory law takes precedence over this Policy.

4. Completed Work

Once the agreed service has been completed and the final deliverables supplied, refunds are not ordinarily provided merely because the client changes their preference or no longer requires the work.

This does not affect rights relating to a genuine failure to provide the agreed service or any other non-waivable legal right.

5. Online Packages

For standardized online packages, please contact us promptly if you wish to cancel.

If production has not yet started, we will review the cancellation in accordance with:

  • the package terms;
  • the status of the project;
  • applicable law.

If work has started, the amount refundable, if any, may reflect work already performed and costs already incurred, to the extent permitted by law.

6. Custom Quotations and Photography Productions

Custom productions may involve reserved production dates, travel, crew, locations, equipment, models, stylists, assistants, permits or other third-party commitments.

The specific quotation may therefore include additional cancellation or postponement terms.

Where a project-specific written quotation conflicts with this general Policy, the project-specific terms will apply to the extent permitted by law.

Non-recoverable third-party costs that were approved or clearly disclosed may remain payable even if the production is cancelled.

7. Rescheduling

Where possible, we may agree to reschedule a project instead of cancelling it.

Rescheduling is subject to availability and may involve additional costs where:

  • suppliers charge change fees;
  • travel has already been booked;
  • locations or personnel must be rebooked;
  • the new schedule materially changes the production.

Any such costs will be communicated before confirmation where reasonably possible.

8. Client Delay or Failure to Supply Materials

If a project cannot proceed because the client has not supplied required materials, information, approvals or access, the delivery schedule may be suspended.

A client delay does not automatically create a right to a refund for work already performed or costs already incurred.

If a project remains inactive for an extended period, we may contact the client to agree a revised schedule or closure of the project.

9. Revisions Are Not Refunds

A request for an agreed revision is not a cancellation request.

If delivered work falls within the agreed brief but requires changes covered by the revision allowance, the normal remedy is to use the included revision process rather than cancel the order.

10. Work Outside the Agreed Scope

If the client requests work materially outside the purchased package or approved brief, we may provide an additional quotation.

Declining additional out-of-scope work does not make the original completed service refundable.

11. Technical or Quality Problems

If you believe there is a genuine problem with delivered work, please contact us with clear details.

Where appropriate, we may first attempt to:

  • correct the issue;
  • replace a defective file;
  • complete an agreed missing requirement;
  • provide an appropriate revision.

This does not restrict any remedy required under applicable law.

12. Refund Method

Approved refunds will normally be returned through the original payment method where practical.

For bank transfers, we may request appropriate banking information required to process the refund.

Banks and payment providers may require additional processing time.

We are not responsible for exchange-rate differences or third-party bank/payment-provider charges outside our control, except where applicable law requires otherwise.

13. Partial Refunds

Where a partial refund is appropriate, it may reflect the portion of the commissioned service that was not performed, after accounting for work and authorized non-recoverable costs already incurred, to the extent permitted by law.

14. Chargebacks

If you believe a payment was incorrect, please contact us first so we can investigate.

Nothing in this Policy limits your lawful rights to contact your bank or payment provider.

Where a chargeback relates to a valid completed or partially completed order, we may provide the payment provider with relevant evidence, including the order, brief, communications, approvals and delivery records.

15. How to Request Cancellation or Refund

Please contact:

ivan3030@hotmail.com

Include:

  • your name;
  • order number;
  • service purchased;
  • reason for the request;
  • whether production has begun, if known.

We will review the request against the project status, applicable agreement and applicable law.

16. Mandatory Consumer Rights

Certain customers may have mandatory rights under Israeli or other applicable consumer-protection laws, including rules concerning distance transactions and cancellation.

Those rights apply regardless of anything in this Policy that would otherwise be inconsistent with them.
